En la primera década del siglo XXI en Argentina se ha producido un notable incremento de los conflictos ambientales, una gran parte de ellos centrados en torno al agua. Paralelamente, se produjeron importantes avances en la institucionalización del paradigma ambiental. En este artículo analizamos el nivel de efectividad de esos avances institucionales en una de las cuencas metropolitanas del Gran Buenos Aires: del río Matanza-Riachuelo, que ha sido escenario de un conflicto emblemático a nivel internacional. La intervención de la Corte Suprema de Justicia Nacional en ese conflicto, cuyo objeto es recomponer el daño ambiental, ha contribuido a la implementación de la gestión integral de los recursos hídricos. Sin embargo, a once años del fallo judicial, sostenemos que es imprescindible la necesidad de coordinación entre los diversos niveles de gobierno e impartición de justicia, incluyendo el internacional, al igual que el respeto hacia los principios básicos del Derecho como el de “legalidad”. La metodología empleada es el análisis de contenido de la legislación y publicaciones oficiales nacionales, de organizaciones no gubernamentales (ONG), artículos académicos y de periódicos y revistas internacionales. In the first decade of the 21st century in Argentina, there has been a notable increase in environmental conflicts, a large part of them centered around water. At the same time, there were important advances in the institutionalization of the environmentalparadigm. In this article, we analyzed the level of effectiveness of these institutional advances in one of the metropolitan basins of Greater Buenos Aires: the Matanza-Riachuelo river, which has been the scene of an emblematic conflict at the international level. The intervention of the Supreme Court of National Justice in this conflict, whose objective is to repair the environmental damage, has contributed to the implementation of the integral management of water resources. However, eleven years after the court ruling, we maintain that the need for coordination between the various levels of justice administration, including international, is essential, as well as respect for the basic principles of law such as legality. The methodology used was the analysis of the content of national legislation and official publications of non-governmental organizations (NGOs), academic articles, and international newspapers and magazines.
